This Addendum to Temporary Construction Easement ("Addendum") is made as of the effective date between the Woodland School District ("District") and Wal-Mart Stores, Inc., a Delaware Corporation ("Wal-Mart").
On September 11, 2007, the District granted Wal-Mart a Temporary Construction Easement ("Easement") over portions of the District's property for public improvements associated with the construction of a new retail store; and
This Easement gave December 31, 2009 as its expiration date; and
Wal-Mart's construction schedule necessitates that this expiration date be extended to December 31, 2010.
NOW, THEREFORE, the Parties agree as follows:
Paragraph 2 of the Easement ("Grant of Easement"), sentence 2, is hereby modified to read as follows: "This easement shall automatically expire and be of no further force or effect on December 31, 2010." All other provisions of the Easement shall remain unchanged and in full force and effect.
