DECLARATION OF SURPLUS PROPERTY
AND NOTICE OF INTENT TO LEASE
WHEREAS, the land located at 11842 Lewis River Road, Ariel, Washington 98603 is owned by the District; and
WHEREAS, a portion of the land located at 11842 Lewis River Road, consisting of 1.199 acres of land legally described in Exhibit “A” to this resolution (“Property”), is not presently needed by the District for school purposes; and
WHEREAS, the Yale Valley Library District has approached the District with a proposal to lease the Property and to construct and operate a public library on the Property; and
WHEREAS, the District and its students, staff, and community members would benefit by the Yale Valley Library District’s proposed use of the Property because the new library will: allow increased access to books, other printed materials, and online resources; provide students with access to library resources at times when the District’s libraries are closed; and provide the opportunity for students to participate in after school and summer educational programs, among other benefits; and
WHEREAS, the Yale Valley Library District’s proposed use of the Property is for lawful purposes, is in the best interest of the District, and will not interfere with the conduct of the District’s educational program and related activities; and
WHEREAS, the District is authorized to lease surplus District property by Board Policy 6112 (“Rental or Lease of District Real Property”) and RCW 28A.335.040, provided that the leasing or renting or use of such property is for a lawful purpose and does not interfere with conduct of the District's educational program and related activities, the lease or rental agreement entered into includes provisions that permit the recapture of the District’s leased or rented surplus property should such property be needed for school purposes, and the Board publishes a notice of intent to rent or lease the surplus property in a newspaper of general circulation in the District at least 45 days before the rental or lease takes effect when the value of the rental or lease is $10,000.00 or more.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF WOODLAND SCHOOL DISTRICT HEREBY RESOLVES AS FOLLOWS:
1. The Board hereby finds that the Property legally described in Exhibit “A” is not presently required for school purposes and declares such property to be surplus property.
2. The Board determines that it is in the best interest of the District to lease the Property to the Yale Valley Library District, provided that the parties can come to mutual agreement on the terms of such a lease, and directs the District’s Superintendent to enter into negotiations with the Yale Valley Library District regarding such a lease.
3. The Board directs the District’s Superintendent to cause notice of the Board’s decision to lease the Property to be published in a paper of general circulation within the District, in accordance with RCW 28A.335.040(3) and Board Policy 6112, and substantially in the language and format of Exhibit “B” to this Resolution.

FORM OF NOTICE OF INTENT TO LEASE SURPLUS REAL PROPERTY
WOODLAND SCHOOL DISTRICT NO. 404
COWLITZ COUNTY, WASHINGTON
NOTICE OF INTENT TO LEASE SURPLUS REAL PROPERTY
NOTICE IS HEREBY GIVEN that the Board of Directors (“Board”) of Woodland School District No. 404, Cowlitz County, Washington (“District”) intends to lease 1.199 acres of the real property owned by the District located at 11842 Lewis River Road, Ariel, Washington 98603 and identified as Cowlitz County parcel EM2402002 (“Property”).
The Board has determined that the Property to be leased is not currently required for school purposes, and has therefore declared this “surplus” property.
The Board intends to lease the Property to the Yale Valley Library District, a Washington public agency, for the purpose of operating a public library. The Board has determined that the lease of the Property for use as a public library will not interfere with the conduct of the District’s educational programs and related activities, and will be in the best interest of the District.
