Concerning the KWRL Transportation Cooperative
Whereas, WAC 392-346-025 sets forth specific requirements for projects utilizing state funding assistance which include the condition that a joint resolution be adopted by the boards of directors of all participating school districts which shall:
(a) Confer contractual authority and subsequent ownership on the board of directors in which jurisdiction the facility is located; and
(b) Designate such board of directors as the legal applicant; and
Whereas, WAC 392-346-025 (6), requires that a statement certifying that a separate account has been established into which participating districts can make deposits in order to pay for all future minor repair and renovation costs; and,
Whereas, on November 29, 2012 the KWRL Cooperative held a joint meeting at which a quorum of each of the Cooperative member districts were present; and,
Whereas, a topic of discussion at the November 29th meeting was the shared financial responsibility for the local costs associated with the renovation and expansion of the KWRL Maintenance facility, including, but not limited to, the costs of the cleanup and mitigation of environmental contaminants and other mitigation associated with potential storm water and wetland requirements associated with the project;
Now Therefore, Be it resolved that:
Contractual authority for matters associated with the remodel, expansion, and future maintenance of the KWRL maintenance facility located at 989 Frazier Lane in Woodland, Washington, will remain with the Woodland Public School District’s Board of Directors;
Consistent with Article 13 of the KWRL Transportation Cooperative Agreement. In the event of dissolution, the Cooperative's maintenance facility shall remain the possession of the Woodland School District;
Woodland Public Schools Board of Directors shall be the legal applicant for matters related to the remodel, expansion, and future maintenance of the KWRL maintenance facility; and,
The member districts agree to a shared financial responsibility for all costs associated with the renovation and expansion of the KWRL Maintenance facility; as well as future maintenance, repair, minor renovation, and other costs (such as environment cleanup) now and in the future of the Cooperative. The financial share shall be based on the provisions of Section 11 Proration of Costs in the Transportation Cooperative Agreement; and,
The Woodland School District shall maintain a separate account into which all participating districts shall, on a proportional share, make deposits in order to pay for all future minor repair and renovation costs.
